1. General conditions of use

General business terms and conditions of online shop on the www.doggycatdreams.com website are prepared in accordance with the slovenian Consumer Protection Act, recommendations of the slovenian Chamber of Commerce and international code for e-commerce.

Before shopping online, you should carefully read the listed terms and conditions.

By using online shop on the www.doggycatdreams.com  website, you accept the listed conditions. In case you do not accept the conditions, we ask you not to use the online shop.

The provider reserves the right to change the conditions without prior notice.

2. Definitions

The provider is the company LTT, Barbara Trifunovic s.p., Majska ulica 12, 2212 Sentilj v Slov.goricah, Slovenia, which manages the online shop on the www.doggycatdreams.com website.
 
The customer is the person who uses the provider’s website and the online shop on this website.
 
The customer is the person who uses the tender’s website and shops in the system of the online shop, which operates on the www.doggycatdreams.com website.
 
The online shop www.doggycatdreams.com is an information system intended for presentation and sale of products.
 
General business conditions concern the provider’s operation, customer rights and the provider-customer business relationship.

4. Access to information

(summary of the legislation)
The provider is committed to always ensure the following information to the customer:
 
a) company identity (name and place of business, number of registry),
b) contact information, which enables quick and efficient communication for the user (e-mail, telephone),
c) essential characteristics of the goods or services (including after-sales services and warranties),
d) product availability (every product or service, which is offered on the website, should be available in a reasonable time period),
e) conditions of product delivery or service performance (method, place and time of delivery),
f) all prices have to be clearly and unambiguously defined and it has to be clearly stated if they already include taxes and delivery costs,
g) payment and delivery method,
h) duration of the offer,
i) period within which it is still possible to withdraw from the contract and conditions for withdrawal; moreover about if and how much it would cost the customer to withdraw,
j) explanation of the complaint procedure, including all the information about the contact person or department for customer contact.
 

5. Using the online store (unregistered or registered visitor)

A visitor can use the online store as an unregistered user, but has the option of quickly registering as a user at each step.

In order to register as a user, the visitor must fill in a registration form, which includes the following information: name, surname, address, e-mail address and telephone number. During the process, the visitor is also notified about the general terms and conditions, which need to be confirmed and accepted.

By registering, the user gains access to their profile where purchase history can be tracked. Registering also allows the user to place orders at the www.doggycatdreams.com online store more quickly and easily, since the information is entered into the system upon registration, meaning that the shipping address does not need to be re-entered when placing subsequent orders. When placing a new order, the user can choose the option to deliver to a different address.

Registration is only possible when all of the mandatory information has been entered and when the general terms and conditions of the www.doggycatdreams.com website have been agreed to. If the user does not want to provide all of the mandatory information or does not accept the general terms and conditions, they will not be able to successfully log in, nor will their registration be successful or valid.

The user’s username and password unambiguously identify the user and link the user to the entered data. After the registration, the user can log in to their profile with the username that is the same as the email address and with the password chosen when registering.

If the user wants to subscribe to notifications on the current special offers and promotions, they can choose to do so during the registration process. This serves as an automatic confirmation and consent to receiving the e-newsletter. The user can also unsubscribe from the newsletter at any time by sending an unsubscribe request to info@doggycatdreams.com.

Privacy and protection of personal data are ensured in accordance with the rules laid down in the following sections of this legal notice.

6. Orders

The sales/purchase contract (order) is stored on the server in electronic form.

To place an order in the www.doggycatdreams.com online store, a login is not necessary. When placing an order, the customer must provide the information necessary for the order to be shipped. Orders can be placed every day between 12 am and 12 pm.

If the customer chooses to collect the order in person at the provider's Showroom, the provider will contact the user as soon as possible by e-mail or phone to arrange the date and time of the collection of the purchased items.

Shipping time is 4 (four) days (shipment date + 4 days).

The provider can reject the order if determined that the order cannot be processed under the given conditions. In such a case, the customer will be notified of the reasons for the order rejection.

 

PURCHASE OF PERSONALIZED ITEMS AND PRINTED MOTIFS

LTT, Barbara Trifunović s.p., gives their customers the option of PERSONALIZING the products by providing a text or a name to be printed on them. It is also possible to customize the products (if the desired materials are in stock) according to the customer’s exact instructions.  The client hereby undertakes to assume full responsibility for the information provided. The customer is also aware that such products may be posted on the Facebook and Instagram pages of the www.doggycatdreams.com online store.

The customer does not have the right to withdraw from the contract and return the product, if the product in question is PERSONALIZED with a print or has been manufactured according to the customer’s exact instructions.

Under the Code of Obligations, the customer is obliged to accept the ordered package and pay for it. If the customer chooses the cash on delivery as their payment option, but does not collect the ordered goods, which are then returned to the sender’s address after the waiting period at the post office, this does not constitute a withdrawal from the contract, as the contract is still legally binding and the customer’s withdrawal was unilateral. If the customer fails to collect the package, this action results in financial losses for the company. In this case, the customer is liable for the costs incurred by the company as a result of shipping/returning the package, as well as the total value of the PERSONALIZED item, for which the customer will be invoiced by the seller and which the customer is obliged to pay, since the customer does not have the right to withdraw from the contract. In the event of the non-payment of the invoice, the claim shall be resolved by the court with appropriate jurisdiction.

In the case of fraudulent orders, the IP address will serve as evidence for further prosecution.

7. Purchasing Process

Purchasing products from our www.doggycatdreams.com online store is easy and convenient. Purchasing products and searching for them is easy, as you can quickly find the desired product with the help of the search box, subcategories and filters.

 

When you find the desired product, click on “Add to cart” and specify the quantity. With some products, you are given the option to have your pet’s name printed on them. You can select the color of the print - gold, silver or black. Unfortunately, it is not possible to select the print size, as they will be selected by the provider. Printing your pet’s name will be charged extra at the rate specified next to the print text length selection field.

The client undertakes to assume full responsibility for the information provided.

When the order contains all the items that you wish to purchase, you need to fill out the quick purchase form or register and place your order as a registered user.

The following payment methods are available: credit card payment, cash on delivery, credit transfer or cash upon collection.

The online store also allows you to enter a promotional code and thereby receive a discount on your purchase. You need to enter your shipping and payment information (credit card details), make sure once again that your order is correct and, finally, confirm the purchase.

Before completing the order, you should take note of the following statement: "By placing the order, the customer assumes the obligation to pay for it". By completing the order you consent to this statement and will receive a copy of the order by e-mail. Submitting the order thus binds you to pay for it.

LTT, Barbara Trifunović s.p. will treat the confirmed orders as irrevocable. For each order you will receive an email with an order confirmation or a notification that the order is being processed. If a mistake has been made during the purchase process, the customer can easily correct the order, replace an item or cancel the order.

An order confirmation will be sent to your email address after the order has been successfully placed. Satisfied customers are of utmost importance to us. Therefore, we will always do our best to meet your wishes. 8. Cancelling an order

Orders placed in the online store can be cancelled by the customer at no additional cost until the receipt of the shipment confirmation email.

Order can be cancelled by sending a notice to info@doggycatdreams.com . The email must include the customer’s basic information: name, surname, address and order number.

9. Limitation of liability

The provider does not assume responsibility for any consequences that may arise as a result of using the website and the content posted thereon. The provider reserves the right to change the content of the website at any time without prior notice and does not assume responsibility for any consequences that may result from these changes.

The provider strives to present the most accurate and up-to-date information that is relevant to the consumer, but the nature of online business may at times prevent this from happening. Product features, delivery period and price can change at such speed that the provider cannot update the information posted on the website in time. The customer will be informed of any such changes during order processing. If a product is not in stock , the customer will be notified and refunded if the payment has been made in advance.

The provider tries to provide the most accurate visual information on individual items. Nevertheless, the photographs of the items should be viewed as symbolic. Visual content does not serve as an accurate representation of the properties of individual items. Due to the nature of the online store, the photographs of the items are digitally and graphically altered. Therefore, the provider does not rule out the possibility of slight discrepancies in the color of the received item. Slight discrepancies in the color of the item can occur due to the use of different display settings or as a result of using different devices to access the online store. Colors and color shades as displayed by certain devices (computer, mobile phone, tablet) deviate from the actual colors and color shades to some extent.

The provider reserves the right to disable the website or to disable the access to it due to technical or other difficulties and maintenance, which also entails disabling or limiting the access to the online store. The provider is not liable for any loss, damage or costs (damage) incurred by the user on account of the online store not being operational. 

The provider is not responsible for the content of the product reviews written by other website users. Product reviews and ratings are the opinions of individual persons and do not necessarily correspond to the views of the editorial staff of the www.doggycatdreams.com website.

10. Offer validity, prices and discounts

Prices are listed as Regular Prices and Special Prices. Regular prices are the prices set by the provider. Your price is the price that applies to online purchases.

Product prices are in Euros (EUR) and include 22% VAT. The provider reserves the right to change the prices daily, unless stated otherwise (e.g. discounts and promotions). Prices are valid from the moment the customer confirms them when placing an order in the www.doggycatdreams.com online store and remain valid until the date of the publication of a new price list. Prices are subject to change without prior notice.

If the price of the product changes during the processing of the order, the provider will give the customer the option to cancel the purchase or offer a solution that will prove satisfactory to both parties.

Occasionally, discount codes are posted on the www.doggycatdreams.com online store.

• Discounts may be expressed as percentages, set amounts or as free items.
• Discounts are valid only when used correctly and according to the rules published on our website.
• Discounts cannot be combined, as they are always tied to one specific order. The same is true for the promotional code that is used when subscribing to the e-newsletter.

The sales/purchase contract between the seller and the customer is concluded at the moment when the customer confirms the order and receives a copy of the order in electronic form at their email address. From this moment on, all prices and other conditions are fixed and valid for both the provider and the customer.

11. Payment methods

The provider accepts the following payment methods:

Cash on delivery

Cash on delivery is a payment made in cash or by card (prior arrangement necessary) when collecting the shipment.

The cash on delivery option is only available for users who want a product from our product assortment to be delivered to their home address in Slovenia.

When choosing the cash on delivery as the payment option, Pošta Slovenije postal service will charge an extra payment handling fee according to their valid price list.

In the event that the customer does not receive the shipment within four (4) working days of the receipt of the shipment confirmation email, the customer must notify the provider by sending an email toinfo@doggycatdreams.com or calling 00386 (0) 40 304 000.


Bank transfer

After the order has been placed, the user will receive an email notification, including an order summary and the information needed to transfer the money to our bank account.

The user undertakes to settle all of their obligations by transferring the money to the bank account of LTT, Barbara Trifunović s.p. within 2 days of placing the order. It is recommended that you notify us after the payment has been made.

If we do not receive your payment within two (2) working days, an invoice for the service provided will be sent to you by post. The user undertakes to settle all of their obligations by transferring the money to the bank account of LTT, Barbara Trifunović s.p. within 8 days of receiving the invoice. In the event of a delay in payment, the company reserves the right to charge default interest at the statutory rate starting from the due date.


Credit card payment

Payment can be made with the following cards:

• MasterCard card,
• Visa card and Visa Electron card.


Cash upon collection

It is possible to pay in cash when collecting the order in person.

If the customer chooses to collect the order in person at the provider's Showroom, the provider will contact the user as soon as possible by e-mail or phone to arrange the date and time of the collection of the purchased items.

12. Delivery

The contracting partner for shipment delivery is Pošta Slovenije, but the provider retains the right to choose another delivery service, if it can help to complete the contract more efficiently.

Delivery by Pošta Slovenija (valid for delivery in Slovenia):
The ordered products will be delivered to the address specified as the delivery address. Deliveries mostly take place in the morning. If you are unable to collect the shipment at the time of delivery, you can pick it up later at the nearest Pošta Slovenije post office. If the shipment is returned to us as a result of incorrectly entered delivery address details by the customer, additional costs will be incurred, which will be borne by the customer. The customer will be charged for the costs of re-shipping such an order to a new address according to the delivery service’s price list. If the customer changes their mind and does not want the order to be re-shipped, they will be refunded any paid purchase price only.

Before completing the order, you should take note of the following statement: "By placing the order, the customer assumes the obligation to pay for it". By completing the order you consent to this statement and will receive a copy of the order by e-mail. Submitting the order thus binds you to pay for it.

During holidays and weekends, delivery times are extended by the number of non-working days.

If the seller ships the ordered products on time and in accordance with the contract, the seller will not be held responsible for the delays in delivery times of the contractual delivery service.


Shipping costs

Slovenia
Costs for shipping within Slovenia are calculated during the order process. Shipping for orders over EUR 60 is free. For shipments up to EUR 59,99, shipping costs are calculated during the purchase process.

EU member countries
Costs for shipping within the EU are calculated during the order process according to the price list of the Pošta Slovenije postal service.

Other countries

Shipping costs are calculated according to the price list of the Pošta Slovenije postal service.
For shipping to other countries, contact us and we will do our best to find a suitable solution.


Returning damaged parcels

If the parcel containing the ordered products is physically damaged; if the packaging is damaged or greasy; if the contents of the parcel are missing or if the parcel seems to have been opened, the customer must file a complaint with the Pošta Slovenije postal service. This can be done by bringing the package to the nearest post office in the same condition as it was received (without adding or removing anything) and by filling out a report. Together with Pošta Slovenije, we will make sure that the complaint is resolved as quickly as possible.

13. Withdrawing from the contract

In the case of distance contracts, the consumer (in accordance with Article 43 of Consumer protection Act) has the right to notify the company of their withdrawal from the contract by email (info@doggycatdreams.com) within fourteen (14) days of receiving the goods.

After having received the aforementioned email, the provider will send the customer the instructions on how to return the goods. The customer has to return the items no later than fourteen (14) days after receiving them to the following address:

If the customer fails to do so (after 14 days), the seller cannot refund the money. The costs of returning the goods are to be borne by the customer. The goods must be sent back by registered mail.

In accordance with the provisions of Article 43d, the customer is held liable for a reduction in the value of the product if the reduction is the result of conduct not strictly necessary to establish the nature, characteristics and functioning of the product.

We therefore suggest that the customer returns the products undamaged and in their original undamaged packaging – it is important to us that the returned items and the packaging are intact and in their original state. The seller will accept the damaged products and notify the customer of the reduction in the value of the product.

If you withdraw from this contract, we will have given you all the payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen (14) days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

The provider may withhold the refund of payments received until the returned item is accepted.

THE CUSTOMER HAS NO RIGHT TO WITHDRAW FROM THE CONTRACT AND RETURN THE PRODUCTS IN THE CASE OF:

• products that have been manufactured according to the customer’s (consumer’s) exact instructions (PERSONALIZED PRODUCTS – WITH PRINT, CUSTOM-MADE PRODUCTS etc.);
• products that have been tailored to customer’s/consumer’s personal needs;
• other products which, due to their nature, cannot be returned;
• products that are damaged or altered in quantity.

 

14. Filing a complaint

The customer can file a complaint within fourteen days of purchase if the goods do not exhibit the properties that were explicitly promised by the seller; if the seller sent the wrong products, products in the wrong quantity or color, or if the products fail to match the customer’s order in any other way.

In this case, the customer may request that the product be replaced immediately with the same, faultless product or that it be replaced within the legal deadline and in accordance with the terms and conditions relating to material defects.

Complaints filed for PERSONALIZED products and/or custom-made products will not be considered.

15. Exchanging an item

If you find that the size of the unused product does not fit, we will replace it with an appropriately sized product within 14 days of receipt, as long as we have it in stock. In this case, the shipping costs are covered by the buyer. The product must also be unused, undamaged and in the original packaging. Enclose a copy of the invoice and specify in writing what it is that you want to replace.

16. Communication

It is also possible to register/ subscribe to the e-newsletter and notifications on the website and online store. By subscribing to the e-newsletter and notifications, the user consents to occasionally receiving updates on the doggycatdreams.com online store, as well as on new offers and promotions. The provider undertakes not to misuse the user's e-mail address in any way and not to pass it on to a third party. In order to subscribe to the newsletter and notifications, a valid e-mail address needs to be entered. After subscribing to the newsletter and notifications, the user will receive an email by the provider, confirming their subscription to the newsletter and notifications. The provider will be sending the newsletter and notifications to the user’s e-mail address at their own discretion. The user can unsubscribe from the newsletter and notifications at any time by clicking the link at the bottom of the received newsletter or notification. The newsletter and notifications received are for information purposes only.

The provider is allowed to communicate with the user of  website www.doggycatdreams.com or customer of online shop www.doggycatdreams.com through the means of distance communication only if the user or customer do not explicitly object to it.

Promotional e-mails by the provider must include the following parts:

• They must be clearly and unambiguously marked as promotional messages.
• The sender must be clearly visible.
• Different sales, promotions and other marketing techniques must be marked as such. Also, the conditions for participation have to be clearly stated.
• The wish by the user or customer not to receive promotional messages has to be respected.

17. Legal notice

The www.doggycatdreams.com website and the content posted thereon are the property of the provider, namely, the provider holds the right to use them and dispose of them. All graphic elements, images, sound and visual materials, as well as other elements, which do not need to be marked as copyrighted due to their nature, constitute intellectual property. The user may not modify, copy, reproduce, repost or in any other way distribute the aforementioned content without explicit prior consent of the provider. Within the permitted use of the content, the user is obliged to retain all designations of copyright and other industrial property rights, as well as any other notices and warnings.

Trademarks, service marks and logos (e.g. the Doggycatdreams trademark and the Doggycatdreams logo) published on the website are the property of the provider, namely, the provider holds the right to use them and dispose of them. The user may not use the stated trademarks, service marks and logos without the prior written permission of the provider.

If one of the general terms is found to be unenforceable, that does not mean that the remainder are too.

18. Complaints

The provider respects the existing consumer protection legislation. The provider has to set up an efficient system for dealing with complaints. Any written complaints regarding demonstrated inconsistencies or regarding incorrect package contents can be sent by email to info@doggycatdreams.com or by regular mail to: LTT, Barbara Trifunović sp, Majska ulica 12, 2212 Šentilj v Slovenskih goricah. The complaint procedure is confidential.

A written complaint must be filed no later than seven (7) days after the delivery of the package, which is the subject of the complaint, and reasons for it must be clearly stated. After this period has passed, the customer loses the right to request a refund from the service provider. The provider must confirm the receipt of the complaint within five (5) working days and let the user know how long it will take to process it, as well as keep the user up-to-date on the progress of the procedure. The estimated time to resolve complaints is fifteen (15) days.

The provider is aware that the key feature of consumer dispute, at least when it comes to solving the case on court, is its asymmetry between the economic value of the claim and costs incurred when resolving the case. This is the main obstacle that the consumer does not initiate the proceedings on court. This is why the provider uses their best endeavours that any disputes resolve amiably.

 

Dispute settlement

Any disputes shall be resolved by the court with appropriate jurisdiction.

19. Exceptional disclosure of personal information

The information, collected and processed by LTT, Barbara Trifunovic s.p., shall be disclosed only if stipulated by the Law on the protection of personal data, or in good faith that such action is necessary for the proceedings on courts or other state bodies.

20. Protection of personal data

We do not store any information you use when paying for the purchase of a device in the online store. However, the data that you will use when registering or ordering goods will be carefully stored and protected in accordance with the Personal Data Protection Act. They will be used only for the purpose of your purchase (here we mean control of the purchase, delivery of goods, ...) and internal information or advertising.

The owner of the LTT website, Barbara Trifunović s.p., undertakes not to sell, lend or in any other way pass on the information you provide to us via the website or in any other way to third parties.

All your information will be treated confidentially and will only be used for internal records and for the purpose for which it was provided to us. Your data will also be carefully protected from loss, misuse, unauthorized access, disclosure, alteration or destruction.
